Bavarian Criminal Police Office denies use of Trojan to eavesdrop on VoIP calls

The Bavarian Criminal Police Office (LKA) has rejected a report according to which it is said to have surreptitiously installed a Trojan on private PCs with the intention of listening in on Internet telephone calls. "That would not make sense, technically speaking," a spokesman of the authority told tagesschau.de, the online edition of the news service of the German public broadcaster ARD. At the same time he admitted that the LKA had eavesdropped on telephone calls made via Voice over IP (VoIP) fewer than ten times. All of these cases had involved "serious criminal offenses and in all of them a judge had issued a warrant beforehand," he declared. Moreover, the data packets had been intercepted on the path between the interlocutors, he added.
On Saturday the German weekly newsmagazine Der Spiegel had reported that the Bavarian Criminal Police Office and the Customs Criminological Office (ZKA) were eavesdropping on Internet telephone calls within the framework of a monitoring-of-telecommunications-at-source regime by the name of Quellen-Telekommunikationsüberwachung (TKÜ). For this the same technology was being deployed that would be used to carry out the highly controversial surreptitious online searches of private PCs the government was pushing for, the magazine writes.
Max Stadler, a domestic affairs experts of the opposition Free Democratic Party (FDP), has called on the Bavarian government to put a stop immediately to all secret online searches that are being carried out within its jurisdiction at present. "It is a sign of blatant disrespect towards Germany's highest court if the government of the federal state of Bavaria can’t be bothered to wait for the Federal Constitutional Court to finish its deliberations and come to a decision," the Passau-based member of the Bundestag, the lower chamber of Germany's Federal Parliament, referring to the deliberations of the Federal Constitutional Court scheduled for Wednesday on a complaint against the license to spy on "information technology systems" that appears in the new security legislation of the federal state of North Rhine-Westphalia, thundered.
Because he is said to have permitted the deployment of the Trojan horse virus the designated minister president of the federal state of Bavaria Günther Beckstein (Christian Social Union; CSU) has, in the opinion of Dirk Niebel, the secretary general of the liberal Free Democratic Party, disqualified himself for his new office. The Bavarian Minister of the Interior "should ask himself whether shortly ahead of his being elected minister president of Bavaria he can put himself in a position that is beyond the law," the liberal politician said in a talk with the German daily Frankfurter Rundschau. A minister president who is prepared to ignore the deliberations and decisions of Germany's highest court "would be a precedent in our state based on the rule of law and is, when all is said and done, not electable" Mr. Niebel added.
